A local Prosecutor has instituted a diversion program for first time low level felony offenders which diverts some offenders into a community based counseling program rather than jail. A plaintiff in a shoplifting case has asked to be placed in the Diversion Program. The Prosecutor needs to make a decision whether or not to accept the plaintiff into the program.
